1. HOLDING CLUB CYBERCARD S.A.S Membership

CYBERCARD benefits program, which grants its holder and beneficiaries the ability to redeem offers established by the ALLIED ESTABLISHMENTS of HOLDING CLUB CYBERCARD S.A.S according to the duly published offers known by the holders. The membership will be considered active as long as the affiliated user is an active client of HOLDING CLUB CYBERCARD S.A.S and, in any case, until the expiration date informed in the mobile application. For the use of the MEMBERSHIP, it is strictly necessary for the affiliated user to have a mobile device whose requirements allow downloading and running the latest version of the CYBERCARD APP on an ANDROID or IOS operating system; additionally, the affiliated user must have internet access at the time of redeeming the offers.

2. CYBERCARD Program Offers

These are the discounts, offers, and benefits that each ALLIED ESTABLISHMENT provides through the CYBERCARD mobile application and/or through the https://reservas.cybercard.com.co/ website, intended for active affiliated users of HOLDING CLUB CYBERCARD S.A.S. These offers are presented in three types: A) PERMANENT OFFER: this is an ongoing offer that the affiliated user can redeem with no limit on the number of uses, through any of the redemption methods established in the application, provided the offer is current and published in the APP or on the https://reservas.cybercard.com.co/ website, and the client complies with the terms and conditions of the particular offer. Affiliated user. B) COUPON OFFER: this is one that the CYBERCARD affiliated user can redeem a limited number of times by presenting virtual coupons redeemable through the CYBERCARD mobile application. These offers are considered valid if they are supported by a virtual coupon contained in the CYBERCARD mobile application. C) ONLINE OFFER: This is an offer intended exclusively to be redeemed through the e-commerce (website or mobile application with purchasing capability) belonging to the allied establishment or a third party, by using a code provided by CYBERCARD which will grant the benefit if the user enters it correctly at the time of finalizing the purchase on the website or application of the allied establishment or third party. These offers can be permanent or for limited use; this quality will be established in the specific terms and conditions of each offer.

3. Available Savings

This is a strictly informative, non-binding, and variable value that aims to compile the total value of the discounts available to the user at establishments with a valid coupon in the selected territory or location. It is an estimate based on the maximum savings the user could obtain if they use all available coupons in the selected territory. In no case does it represent a determined or enforceable value from CYBERCARD, as it is a variable estimated figure subject to the availability of offers and the user's consumption decisions. This estimate may vary without prior notice due to: a) use of coupons by the affiliate, b) expiration of offers or their removal, c) variation in the available offers, d) variation in the base rate value used to calculate the savings, e) for reasons beyond CYBERCARD's control. This value only considers specific offers or coupons.

4. Offer Redemption Methods

The benefits of the HOLDING CLUB CYBERCARD S.A.S membership may be redeemed directly by the AFFILIATE or beneficiaries using the redemption methods available in the offer published in the application, which may include, but are not limited to, the following: i) By scanning a QR code provided by the ALLIED ESTABLISHMENT ii) By entering the redemption code in the APP that the allied establishment provides to the user. iii) Through a request via WhatsApp to the allied establishment, sent by the membership holder. iv) By presenting the virtual CYBERCARD to the allied establishment. v) By making a phone call to the number indicated in the "call" redemption option located in the respective offer. vi) Redemption for online purchases, whereby the CYBERCARD APP provides a discount code that must be used by the user when finalizing the purchase on the e-commerce platform (website or mobile application with online purchasing capability of the affiliated establishment). In this redemption method, the user must, if necessary, have proper access and/or registration on the application or website with online purchasing capability of the establishment or third party. CYBERCARD is exempt from liability regarding the provision of personal data or information on the third-party application, as it is not under its control. vii) Any other redemption method that CYBERCARD deems appropriate, duly informs, and publishes. In any case, any type of redemption requires that the person intending to obtain the benefits of an allied establishment identify themselves with a legitimate document as a HOLDER or BENEFICIARY with a valid membership. The validity of the offers requires following and complying with the redemption methods stipulated herein.

5. Membership Holder

A natural or legal person who has acquired the HOLDING CLUB CYBERCARD S.A.S membership through the sales channels provided for this purpose. The holder acquires all the benefits of the CYBERCARD program MEMBERSHIP and also has the ability to share said benefit with a limited number of beneficiaries according to the plan purchased by the HOLDER. The beneficiary's information will be provided directly by the HOLDER.

6. Beneficiary

A natural person who, through a MEMBERSHIP HOLDER, acquires the right to enjoy the benefits of the HOLDING CLUB CYBERCARD S.A.S program's offers free of charge, by the will and communication of the membership holder. The beneficiary acquires their status as an accessory to the HOLDER; therefore, the duration of their benefits is directly tied to the status of the HOLDER's subscription from which the benefits were derived.

7. Referral

A natural person who, through a MEMBERSHIP HOLDER who has previously acquired the HOLDING CLUB CYBERCARD S.A.S benefits program, acquires the possibility of obtaining the benefits of the HOLDING CLUB CYBERCARD S.A.S program by activating an access code sent by the MEMBERSHIP HOLDER. Once the code is received, the REFERRAL has the ability to download the CYBERCARD application and activate the code, which will grant access to the program's benefits regarding permanent offers and coupons for a period of 90 calendar days from the moment of activation.

8. Allied Establishments

These are all legal or natural persons who authorize the publication of an offer for their products and/or services through the following means of dissemination: I) through the mobile application owned by CYBERCARD a) either by directly entering said mobile application or b); or II) through the website https://reservas.cybercard.com.co/.

9. Distributor

A natural or legal person who has entered into an agreement with HOLDING CLUB CYBERCARD S.A.S and is therefore authorized to distribute the CYBERCARD benefits plan directly and under its own name, delivering these benefits to its clients for the limited period indicated at the time of activation as a courtesy or added value. The benefits of the CYBERCARD program offered through a DISTRIBUTOR will always be independent in terms of liability, requirements, and effects from the goods and services offered by the distributor, even when such products or services are offered simultaneously in the same legal act. Therefore, CYBERCARD is exempt from liability regarding the contractual negotiations that the DISTRIBUTOR carries out with its clients. The benefits granted by CYBERCARD indirectly or through a DISTRIBUTOR cannot be accumulated or used simultaneously with other offers or promotions made by the ALLIED ESTABLISHMENT. 9. Gift

This is a section of the CYBERCARD APP where additional programs are displayed that CYBERCARD may offer to its affiliated users free of charge, as a courtesy or added value, in order to provide the user with additional tools and/or benefits. These programs or services are at the discretion of HOLDING CLUB CYBERCARD S.A.S; therefore, given their accessory and free nature, they may be added, revoked, or modified at the discretion of HOLDING CLUB CYBERCARD S.A.S without prior notice. The additional programs may be provided by third parties unrelated to CYBERCARD, who are responsible for ensuring the suitability of the service under the offered terms and conditions. In any case, HOLDING CLUB CYBERCARD S.A.S is exempt from liability regarding the results of the provision of the additional product provided by the third party.

10. Payment Methods

The payment methods available on the CYBERCARD website and mobile app are: Online payments (credit or debit card, PSE, cash payments at allied stores) through the Openpay payment gateway. 2. Right of Withdrawal

In the event that the CONSUMER has purchased the product using a non-conventional sales channel (telephone, virtual, and in any case non-face-to-face sales), they will have the right to exercise the withdrawal of the purchase within a period of 5 business days after the purchase is completed. For this purpose, the CONSUMER must send a written communication stating their desire to exercise the right of withdrawal to the email address [email protected]. Upon verification that the requirements for the right of WITHDRAWAL are met, CYBERCARD AND/OR THE DISTRIBUTOR will issue a full refund of the money paid no later than 30 calendar days after the request, without any withholding. 3. Warranty

The legal warranty contained in Law 1480 of 2011 will be applicable to the services offered through the platform.
